This document sets out the terms on which you may access and use the Deep Movement Collective platform, mobile application, website, and related services. Please read these Terms carefully before using our Services.

1. Introduction and Acceptance of Terms

Welcome to Deep Movement Collective ("DMC", "we", "us", or "our").

These Terms and Conditions ("Terms") govern your access to and use of the DMC website (the-dmc.com), mobile application (available on iOS and Android), member dashboard, and any offline meetups, activities, or events organised through DMC (together, the "Services").

By clicking "Apply", creating an account, downloading or using our mobile application, or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, please do not use the Services.

If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you have authority to accept these Terms on its behalf, and "you" refers to that entity.

2. Who We Are

Deep Movement Collective is a global founder community that connects entrepreneurs through curated small-group, movement-based meetups in their city. DMC is currently live in cities across South Africa and the United Kingdom, with plans to expand to additional cities and countries.

The Services are operated by Deep Movement Collective LLC, a company formed under the laws of Delaware, United States.

3. Eligibility

To use DMC you must:

  • Be at least 18 years old.
  • Have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
  • Provide accurate and complete information when you create an account and during onboarding.
  • Comply with these Terms, our Privacy Policy, our Community Guidelines, and any additional policies we share with you.
  • Not have been previously removed or banned from DMC.

We may refuse, suspend, or cancel membership or access to the Services at our discretion if we reasonably believe these conditions are not met.

4. Accounts and Onboarding

4.1 Account Creation

To apply to join DMC you must provide at minimum:

  • First and last name
  • Email address
  • Password
  • City
  • Date of birth
  • Gender
  • WhatsApp or mobile number

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@the-dmc.com if you believe your account has been compromised or accessed without your authorisation.

You may not create more than one account, share your account credentials with anyone, or transfer your account to another person.

4.2 Profile Accuracy

You agree that all information you provide during registration and onboarding is truthful, accurate, and current. You must promptly update your profile if any information changes. We may suspend or terminate accounts that contain materially false or misleading information.

4.3 Waitlisted and Supported Cities

DMC activates cities in stages. If your city is supported, you may proceed through full onboarding and, once you subscribe, become eligible for periodic matching. If your city is not yet supported, you may join the waitlist. You will not be billed or matched until your city is activated and you choose a subscription plan.

We may change which cities are supported, or when they are activated, at our discretion and without prior notice.

5. Membership, Subscriptions, and Billing

DMC is a paid membership service. Pricing and plans may differ by country, currency, or promotional offer.

5.1 Plans

We currently offer the following subscription plans:

  • Monthly membership
  • Quarterly membership
  • Yearly membership

Details of pricing, currency, and any trial, founding member, or promotional offers are displayed at checkout and may change from time to time. Any changes to pricing will not affect your current billing period.

5.2 Free Trials

We may offer free trial periods at our discretion. Trial terms (duration, features, and any limitations) will be communicated at sign-up. Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan at the applicable rate. A valid payment method is required to start a trial.

5.3 Billing and Payment Processing

Payments are processed via Stripe or other third-party payment processors that we may use from time to time. Payment processing occurs through your web browser and is directed to Stripe's secure payment page. By starting a subscription, you authorise us and our payment processors to charge the applicable fees to your chosen payment method on a recurring basis in line with your selected plan.

You are responsible for ensuring your payment information is accurate and up to date. DMC does not store your full payment card details; these are held securely by our payment processor in accordance with PCI-DSS standards.

5.4 Auto-Renewal

All plans automatically renew at the end of each billing period unless you cancel before the renewal date:

  • Monthly plans renew each month.
  • Quarterly plans renew every 3 months.
  • Yearly plans renew each year.

You can manage or cancel your subscription at any time through your account dashboard, via the links in your confirmation emails, or by contacting us at support@the-dmc.com.

5.5 Cancellations and Refunds

If you cancel, your membership continues until the end of your current billing period and will not renew thereafter. You will retain access to the Services for the remainder of that period.

We generally do not offer refunds for partial periods, unused match cycles, or missed meetups.

UK and EU consumers: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) and equivalent EU consumer protection legislation, you have a statutory right to cancel your subscription within 14 days of purchase ("cooling-off period") and receive a full refund, provided that the Services have not been fully performed during that period. By using the Services during the cooling-off period (including being matched with other members), you expressly acknowledge and agree that the performance of the Services has begun, and you consent to the loss of your right of withdrawal once the Services are fully performed within that 14-day window. If you cancel within the cooling-off period after partial performance, you may be entitled to a proportionate refund for the unperformed portion.

South African consumers: Your rights under the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") are not limited by these Terms. Where the CPA or ECTA provides you with greater protections, those protections will apply.

If we materially fail to provide the Services you paid for, please contact us at support@the-dmc.com and we will review your case fairly.

5.6 Failed Payments and Past-Due Accounts

If a payment fails:

  • Your subscription may enter a "past due" state while our processor retries payment.
  • We may notify you by email or push notification and request that you update your payment method.
  • If payment is not successfully collected after a reasonable period (typically 7–14 days), we may suspend or cancel your membership and your eligibility to be matched in upcoming cycles.
  • You remain responsible for any amounts owed.

6. What DMC Provides

DMC provides:

  • A digital platform (web and mobile) where you can create a profile, share your business goals, activity interests, and match preferences.
  • A proprietary matchmaking engine that, on a periodic basis, groups eligible members in the same city into small groups for offline meetups.
  • A member dashboard and mobile app to view your matches, communicate with your group, update your details, and manage your subscription.
  • City-wide events and community activities, where available.

We do not guarantee:

  • That you will be matched every cycle, especially if there are not enough compatible members in your city or if your preferences are very specific.
  • Any particular business outcome, friendship, partnership, investment, or personal result from your participation in DMC.
  • That all members will behave in line with our Community Guidelines, although we take reasonable steps to uphold community standards.
  • Continuous, uninterrupted availability of the Services.

7. Meetups and Movement Activities

DMC's core experience involves movement-based offline meetups (for example, walks, hikes, runs, yoga, or other light physical activity) facilitated through our platform.

7.1 Participation at Your Own Risk

By taking part in any DMC-related meetup or activity, you acknowledge and agree that:

  • Physical activity carries inherent risks, including the risk of injury, illness, or in extreme cases, death.
  • Outdoor and urban environments carry risks such as uneven terrain, weather conditions, traffic, wildlife, and interactions with third parties.
  • You are solely responsible for assessing your own physical and mental fitness to participate.
  • You will consult a medical professional before participating if you have any health conditions or concerns about your ability to participate safely.
  • You participate voluntarily and entirely at your own risk.
  • DMC does not provide medical, fitness, or mental health advice and is not a healthcare provider.

7.2 Personal Responsibility and Safety

You agree to:

  • Use common sense, act responsibly, and respect all applicable local laws and regulations.
  • Bring appropriate clothing, footwear, hydration, sun protection, and any equipment suitable for the planned activity and conditions.
  • Inform your group of any health considerations they should be aware of, if you choose to share them.
  • Immediately stop participating if you feel unwell, unsafe, or uncomfortable.
  • Not attend meetups under the influence of alcohol or drugs to a degree that could impair your safety or that of others.

DMC is not responsible for transportation to or from meetups, personal belongings, or any damage or loss that arises during your travel or participation.

8. Community Standards and Member Conduct

DMC is built for depth, trust, and real human connection. To protect the safety and integrity of our community, you agree that you will not:

  • Harass, bully, threaten, stalk, or abuse any other member, whether online or offline.
  • Discriminate against or demean others based on race, ethnicity, gender, gender identity, sexual orientation, religion, nationality, age, disability, or any other protected characteristic.
  • Engage in sexual harassment or unwanted romantic or sexual pressure toward other members.
  • Use DMC events or the platform primarily to pitch, spam, or aggressively sell products, services, investments, or recruitment opportunities (including multi-level marketing, cryptocurrency schemes, "get rich quick" schemes, or similar).
  • Record, photograph, or share another member's personal stories, experiences, or likeness without their clear, informed consent.
  • Misrepresent your identity, business, qualifications, or intentions.
  • Bring weapons, illegal drugs, or any dangerous items to meetups.
  • Attempt to circumvent any security, access control, or technical measures of the platform.
  • Engage in any conduct that, in our reasonable view, harms the safety, trust, or reputation of the community.

We may investigate reports of misconduct and, at our discretion, warn, suspend, or permanently remove members who breach these standards. In serious cases, we may report conduct to law enforcement authorities.

9. Confidentiality and Discretion

DMC meetups often involve personal, emotional, or sensitive conversations between members.

By joining DMC you agree to:

  • Treat personal information and stories shared by other members as confidential.
  • Not publicly share, publish, post on social media, or otherwise disclose another member's identity, business details, or personal story without their explicit permission.
  • Use discretion when sharing your own experiences that involve other members.

We cannot guarantee that every member will always uphold these standards, but we treat serious breaches as grounds for warning, suspension, or removal from DMC.

10. Intellectual Property

10.1 Our Content and Platform

All content provided through the Services — including the DMC name, logo, brand assets, text, graphics, illustrations, videos, the matching algorithm, software, tools, and underlying technology — is owned by DMC or our licensors and is protected by applicable intellectual property laws.

You may not:

  • Copy, modify, distribute, sell, lease, or create derivative works from any part of the Services.
  • Use our trademarks, service marks, or branding without our prior written permission.
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the platform, mobile application, or matching algorithm.
  • Use any automated system, bot, scraper, or data-mining tool to access, extract data from, or interact with the Services.
  • Frame, mirror, or replicate any part of the Services on any other platform or server.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Services for your own personal and professional development purposes.

10.2 Your Content

You may share content through DMC, including profile information, photos, links, stories, feedback, testimonials, and messages.

By submitting content, you grant DMC a worldwide, non-exclusive, royalty-free, sublicensable licence to use, copy, store, modify, display, and distribute that content as reasonably needed to operate, improve, and promote the Services. This licence continues for as long as your content remains on the platform and for a reasonable period after removal to allow for backup and archival purposes.

You may request removal of your content by contacting us at support@the-dmc.com. We will use reasonable efforts to remove it, although some copies may remain in backups, cached versions, or historical records.

You represent and warrant that you own or have the necessary rights to share any content you submit, and that it does not infringe or violate the rights of any third party.

11. Privacy and Data Protection

We take your privacy seriously and are committed to protecting your personal data in compliance with applicable data protection laws.

11.1 Data Controller

Deep Movement Collective LLC is the data controller (or "responsible party" under South African law) for personal data collected and processed through the Services.

11.2 What We Collect

We collect and process personal data to operate DMC, including but not limited to:

  • Registration and onboarding information (name, email, date of birth, gender, city, phone number).
  • Profile data (interests, goals, professional background, photos).
  • Activity and preference data used by our matching algorithm.
  • Payment and billing information (processed and stored by Stripe; DMC does not store full card details).
  • Usage data, device information, and analytics from the platform and mobile app.
  • Communications you send us or share through the platform.

11.3 Legal Basis for Processing

We process your personal data on the following legal bases:

  • Contractual necessity: to provide the Services you have subscribed to, including matching, account management, and billing.
  • Legitimate interest: to improve our Services, prevent fraud, ensure platform security, and communicate service-related updates.
  • Consent: for optional processing such as marketing communications, push notifications, and certain analytics. You may withdraw consent at any time.
  • Legal obligation: where we are required to process data to comply with applicable laws.

11.4 International Data Transfers

DMC is based in the United States. If you are located in the United Kingdom, European Economic Area, South Africa, or another jurisdiction with data protection laws, your personal data may be transferred to and processed in the United States or other countries where our service providers operate.

We ensure appropriate safeguards are in place for international transfers, including Standard Contractual Clauses (SCCs) approved by the UK Information Commissioner's Office or the European Commission, or other lawful transfer mechanisms.

11.5 Your Data Rights

UK and EEA residents (GDPR / UK GDPR): You have the right to access your personal data; request rectification of inaccurate data; request erasure ("right to be forgotten"); restrict or object to processing; request data portability; withdraw consent at any time; and lodge a complaint with the UK Information Commissioner's Office (ICO) or your local supervisory authority.

South African residents (POPIA): Under the Protection of Personal Information Act 4 of 2013 ("POPIA"), you have the right to be notified when your personal information is collected; request access to your personal information; request correction or deletion of your personal information; object to the processing of your personal information; and lodge a complaint with the Information Regulator (South Africa).

To exercise any of these rights, please contact us at support@the-dmc.com. We will respond within the timeframes required by applicable law (typically 30 days).

11.6 Data Retention

We retain your personal data for as long as your account is active and for a reasonable period thereafter to comply with our legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes. Specific retention periods are detailed in our Privacy Policy.

11.7 Privacy Policy

Our use of your data is described in further detail in our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully at the-dmc.com/privacy.

12. Electronic Communications and Notifications

By creating an account, you consent to receive electronic communications from DMC, including:

Transactional communications: account confirmations, match notifications, billing receipts, subscription updates, and service-related announcements. These are necessary for the operation of the Services and cannot be opted out of while your account is active.

Push notifications: match alerts, meetup reminders, and community updates via our mobile app. You can manage push notification preferences in your device settings or within the app.

Marketing communications: newsletters, feature announcements, promotional offers, and community content. You may opt out of marketing communications at any time by clicking the unsubscribe link in any email, updating your preferences in your account dashboard, or contacting us at support@the-dmc.com.

You agree that electronic communications from DMC satisfy any legal requirement that such communications be in writing.

13. Mobile Application

13.1 Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the DMC mobile application on a device that you own or control, solely for your personal use in connection with the Services.

13.2 App Store Terms

If you download the DMC app from the Apple App Store, Google Play Store, or any other app distribution platform ("App Store"), you acknowledge and agree that:

  • These Terms are between you and DMC, not with the App Store provider.
  • The App Store provider has no obligation to provide maintenance, support, warranty, or other services for the app.
  • In the event of any failure of the app to conform to any applicable warranty, the App Store provider's maximum liability is limited to refunding the purchase price of the app (if any).
  • The App Store provider is not responsible for addressing any claims by you or third parties relating to the app.
  • The App Store provider is a third-party beneficiary of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.

13.3 Updates

We may release updates, patches, or new versions of the app from time to time. Some updates may be required for continued use of the Services. Where possible, we will notify you of material updates, but you are responsible for keeping the app up to date.

14. Account Deletion

You have the right to request full deletion of your account and associated personal data at any time. You can do this by:

  • Using the account deletion feature in the app or account dashboard.
  • Emailing us at support@the-dmc.com with the subject line "Account Deletion Request."

Upon receiving a valid deletion request, we will:

  • Cancel any active subscription and stop all future billing.
  • Delete or anonymise your personal data within 30 days, except where we are required to retain certain data by law, for fraud prevention, or to resolve disputes.
  • Remove your profile from visibility to other members.

Account deletion is permanent and cannot be reversed. If you wish to use DMC again, you will need to create a new account.

15. Prohibited Technical Conduct

You agree that you will not, directly or indirectly:

  • Use any automated system, software, bot, scraper, crawler, or similar tool to access, collect data from, or interact with the Services.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, or data structures of the platform or app.
  • Interfere with, disrupt, or place an unreasonable load on the Services or the networks or servers connected to the Services.
  • Attempt to gain unauthorised access to any part of the Services, other users' accounts, or any systems or networks connected to the Services.
  • Introduce viruses, malware, trojans, or other harmful code to the Services.
  • Use the Services to send unsolicited communications, spam, or chain messages.
  • Circumvent, disable, or interfere with any security, authentication, or access control features of the Services.

Violation of this section may result in immediate suspension or termination of your account and may give rise to civil or criminal liability.

16. Termination and Suspension

You may stop using DMC at any time and may cancel your subscription through your account dashboard or by contacting us.

We may, with or without notice, suspend or terminate your access to all or part of the Services if:

  • You violate these Terms, our Privacy Policy, or our Community Guidelines.
  • We reasonably believe your conduct poses a risk of harm to other members, DMC, or third parties.
  • We are required to do so by law or by a government or regulatory authority.
  • We discontinue or materially change the Services.

If we terminate your account for breach of these Terms, you are not entitled to a refund of any fees already paid, except where required by applicable law.

Upon termination, your licence to use the Services immediately ceases. Sections of these Terms that by their nature should survive termination will continue to apply, including sections on confidentiality, intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

17. Disclaimers

To the maximum extent permitted by applicable law:

  • The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
  • We disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • We do not guarantee uninterrupted, secure, or error-free operation of the Services, or that the Services will meet your expectations.
  • We make no guarantees about business outcomes, fitness outcomes, friendships, partnerships, funding, or any specific results from participating in DMC.
  • Nothing in DMC's materials or communications should be taken as financial, legal, medical, or mental health advice.
  • We do not guarantee the accuracy, completeness, or reliability of any member profiles, content, or information shared through the Services.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions apply to the maximum extent permitted by applicable law.

18. Limitation of Liability

18.1 Exclusion of Certain Damages

To the maximum extent permitted by applicable law, DMC, its founders, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, or other intangible losses, arising out of or related to your use of the Services, participation in any meetups, or these Terms.

18.2 Overall Cap

Our total aggregate liability to you for any and all claims arising out of or relating to the Services or these Terms will be limited to the greater of:

  • The total amount you have paid to DMC for membership in the 12 months immediately preceding the event giving rise to the claim; or
  • USD $100 (or the equivalent in your local currency at the time of the claim).

18.3 Physical Activities and Meetups

Without limiting the above, DMC will not be liable for any injury, accident, illness, property damage, or loss that occurs before, during, or after any DMC-related meetup or activity, except where such exclusion is not permitted by applicable law.

18.4 Applicability

These limitations apply whether the claim is based on contract, tort (including negligence), strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law (including consumer protection laws in the United Kingdom and South Africa).

19. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless DMC, its founders, directors, employees, contractors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Services or participation in any DMC-related activity.
  • Your breach of these Terms, our Privacy Policy, or our Community Guidelines.
  • Your content or conduct that infringes or violates the rights of any third party.
  • Any inaccurate information you provide through the Services.

This indemnity does not apply to the extent that the claim arises from our own negligence or breach of these Terms.

20. Dispute Resolution

20.1 Informal Resolution

Before filing any formal legal action, you agree to first try to resolve any dispute with DMC informally. Please contact us at support@the-dmc.com with a description of your concern. We will attempt to resolve the dispute within 30 days of receiving your notice.

20.2 Binding Arbitration

If we cannot resolve a dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms or the Services (other than claims for injunctive relief or claims regarding intellectual property rights) will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration will be conducted in English, and the seat of arbitration will be Delaware, United States.

The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The arbitrator may award the same damages and relief as a court, but may not consolidate claims or preside over any form of class or representative proceeding.

20.3 Class Action Waiver

To the maximum extent permitted by applicable law, you and DMC each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against DMC.

20.4 Consumer Protection Carve-Outs

UK consumers: Nothing in this section prevents you from bringing a claim in the courts of England and Wales (or Scotland or Northern Ireland if you reside there), as required under UK consumer protection law. The mandatory arbitration and class action waiver provisions in sections 20.2 and 20.3 do not apply where they would conflict with your statutory rights under UK law.

South African consumers: Nothing in this section limits your right to approach the National Consumer Tribunal, the Information Regulator, or any competent court in South Africa, as provided by the Consumer Protection Act 68 of 2008 or the Protection of Personal Information Act 4 of 2013.

21. Force Majeure

DMC will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, government actions or restrictions, war, terrorism, civil unrest, strikes, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.

In the event of a force majeure occurrence, we will use reasonable efforts to notify affected members and to resume normal operations as soon as practicable. If a force majeure event continues for more than 90 days, either party may terminate the affected subscription, and you will receive a pro-rata refund for any prepaid period during which the Services were unavailable.

22. Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles, except as provided below.

UK users: If you are a consumer habitually resident in the United Kingdom, you will benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law, and any disputes may be brought in your local courts.

South African users: If you are a consumer in South Africa, nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008 or the Protection of Personal Information Act 4 of 2013, and disputes may be brought before any competent court or tribunal in South Africa.

23. Changes to the Services and These Terms

We are continuously improving DMC and may:

  • Add, change, suspend, or remove features or components of the Services.
  • Update these Terms from time to time.

If we make material changes to these Terms, we will notify you by email, through the platform or app, or by updating the "Last Updated" date at the top of this document. We will provide at least 14 days' notice before material changes take effect, except where changes are required by law or relate to new features.

Your continued use of the Services after the updated Terms take effect constitutes your acceptance of those changes. If you do not agree with the updated Terms, you should stop using DMC and cancel your membership before the changes take effect.

24. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, apps, or services (for example, Stripe for payments, email service providers, analytics tools, or partner venues). Use of those third-party services is subject to their own terms and privacy policies.

We do not control and are not responsible for third-party services, their content, or their data practices. Your use of any third-party service is at your own risk. We encourage you to review the terms and privacy policies of any third-party services you access through DMC.

25. General Provisions

25.1 Entire Agreement

These Terms, together with our Privacy Policyand Community Guidelines, constitute the entire agreement between you and DMC regarding your use of the Services and supersede all prior agreements, understandings, and communications (whether oral or written) relating to the subject matter.

25.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it will be severed. The remaining provisions will continue in full force and effect.

25.3 No Waiver

Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by DMC.

25.4 Assignment

You may not transfer or assign your membership, account, or any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of our assets, provided the assignee agrees to honour these Terms.

25.5 Notices

Any notices from DMC to you will be sent to the email address associated with your account or delivered through the platform or app. You are responsible for keeping your email address current. Notices from you to DMC should be sent to support@the-dmc.com.

Notices are deemed received: immediately if delivered in-app; 24 hours after sending if sent by email; or 5 business days after sending if sent by post.

25.6 Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and DMC. You have no authority to act on behalf of DMC or to bind DMC in any way.

25.7 Language

These Terms are drafted in English. If these Terms are translated into any other language, the English version will prevail in the event of any inconsistency.
